HSM Condo Collection is operated by HSM Realty Inc. (“HSM,” “we,” “us,” or “our”). This Privacy Policy explains how we collect, use, disclose, and protect personal information when you use HSM Condo Collection, communicate with us, create an account, request real estate or professional services, or otherwise interact with the platform. 1. INFORMATION WE COLLECT Depending on how you use HSM Condo Collection, we may collect the following categories of information: Information you provide directly - Name, email address, telephone number, and other contact information. - Account and profile information. - Property interests, saved properties, search preferences, and information you provide about buying, selling, renting, or leasing a condominium. - Information submitted through inquiries, consultation requests, professional-selection workflows, support requests, and other forms. - Communications you send to HSM or participating professionals through HSM-supported workflows. Professional information For real estate professionals and other participating professionals, HSM may collect professional and business information such as: - name and contact information; - company, brokerage, firm, or office affiliation; - licensing, registration, credential, or professional-authorization information; - jurisdiction and service coverage; - professional services and qualifications; - participation, compliance, insurance, or verification information where applicable. Some professional information may also be obtained from public records, licensing or regulatory authorities, professional sources, or information supplied by the professional. Account and security information When accounts are used, HSM may process information necessary to authenticate users, protect accounts, prevent unauthorized access, maintain security, and record important account or platform events. Technical and usage information When you access HSM Condo Collection, we and our service providers may automatically receive limited technical information such as: - IP address; - browser and device information; - operating system; - referring or requested pages; - timestamps; - application and security logs; - error and performance information; and - information necessary to maintain, secure, and troubleshoot the service. Real estate and marketplace information HSM may process property, building, neighborhood, market, listing, and related real estate information received from HSM, authorized real estate data sources, participating professionals, public sources, or other permitted sources. Please do not submit sensitive personal information in free-text fields unless HSM specifically requests that information for a legitimate and disclosed purpose. 2. HOW WE USE INFORMATION HSM may use personal information to: - provide and operate HSM Condo Collection; - create and maintain user accounts; - authenticate users and protect account security; - provide property search, building research, saved-property, comparison, and related tools; - respond to inquiries and consultation requests; - support buying, selling, rental, and landlord workflows; - allow consumers to identify and select eligible participating professionals; - carry out consumer-authorized professional connection and request-delivery workflows; - verify professional participation, licensing, credentials, jurisdiction, services, and eligibility where applicable; - communicate regarding accounts, inquiries, requested services, security, support, and platform operations; - prevent fraud, abuse, unauthorized access, and misuse; - maintain security, audit history, reliability, and platform integrity; - diagnose technical problems and improve platform performance; - comply with legal, regulatory, licensing, contractual, and professional obligations; - establish, exercise, or defend legal rights; and - perform other purposes disclosed to you at the time information is collected or with your consent where required. HSM seeks to collect and use personal information that is reasonably necessary for the applicable purpose. 3. PROFESSIONAL SELECTION AND INFORMATION SHARING HSM Condo Collection is designed to preserve consumer choice. When you expressly select or request connection with a participating professional, HSM may share the information reasonably necessary to facilitate that requested connection. HSM does not disclose a consumer’s private contact information to candidate professionals merely because those professionals may qualify to appear as choices in an HSM Assistance workflow. Consumer information may be provided to a selected professional only through the applicable consent, eligibility, validation, and delivery process. 4. HOW WE DISCLOSE INFORMATION HSM may disclose personal information to the following categories of recipients when reasonably necessary: Participating professionals When you request, select, or authorize connection with an eligible participating professional, information necessary for that requested interaction may be provided to that professional. Service providers HSM may use service providers that support functions such as hosting, authentication, security, communications, infrastructure, application operations, and other technology services. These providers may process information on HSM’s behalf according to the services they provide. Real estate and professional data sources Where necessary to operate the platform, information may be exchanged with or verified through authorized real estate data providers, licensing or regulatory sources, professional-verification sources, or other permitted data sources. Legal, regulatory, and safety purposes HSM may disclose information when reasonably necessary to comply with applicable law, legal process, regulatory requirements, licensing obligations, protect rights or safety, investigate fraud or abuse, or protect the security and integrity of HSM Condo Collection. Business transactions If HSM or an applicable business operation is involved in a merger, acquisition, financing, reorganization, sale of assets, or similar transaction, information may be transferred subject to applicable law and appropriate safeguards. HSM does not currently sell personal information or process personal information for targeted advertising as those terms are defined under applicable state consumer privacy laws. If HSM's practices materially change in the future, this Privacy Policy will be updated and any legally required choices or opt-out mechanisms will be provided before or when required. 5. COOKIES, LOGS, AND SIMILAR TECHNOLOGIES HSM Condo Collection and its service providers may use cookies, session technologies, logs, and similar technologies that are necessary to: - authenticate users; - maintain sessions; - remember appropriate user preferences; - protect security; - prevent fraud or abuse; - maintain application functionality; - diagnose errors; and - understand application performance. If HSM later activates analytics, advertising, or other technologies that require additional notice or consumer choice under applicable law, HSM will provide the required notice or controls. 6. DATA SECURITY HSM uses administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, misuse, alteration, disclosure, or destruction. Security measures include access controls and other safeguards appropriate to the systems and information involved. No internet service, transmission method, or storage system can be guaranteed to be completely secure. Users should protect their login credentials and notify HSM if they suspect unauthorized access to their account. 7. DATA RETENTION HSM retains personal information for as long as reasonably necessary for the purposes for which it was collected and as needed to: - provide requested services; - maintain account and transaction or request history; - meet legal, regulatory, licensing, contractual, audit, or recordkeeping obligations; - prevent fraud or abuse; - maintain security; - resolve disputes; and - enforce agreements. Retention periods may differ depending on the type of information and the purpose for which it is maintained. HSM does not establish a specific legal retention period in this Privacy Policy where no such period has been formally adopted. 8. YOUR PRIVACY RIGHTS Depending on where you reside and applicable law, you may have rights concerning your personal information, which may include the right to: - confirm whether HSM processes your personal information; - access personal information about you; - obtain a copy of certain personal information; - correct inaccurate personal information; - request deletion of personal information, subject to applicable exceptions; - request information about how personal information is used or disclosed; - withdraw consent where processing is based on consent; - opt out of certain processing where applicable law provides that right; and - appeal certain decisions regarding a privacy-rights request where applicable. HSM will not unlawfully discriminate against you for exercising an applicable privacy right. Rights vary by jurisdiction and are subject to applicable legal exceptions. 9. For security and privacy protection, HSM may need to verify your identity before providing, correcting, or deleting personal information. You are not required to create a new HSM account solely to submit a privacy request. If you already have an account, HSM may use existing account authentication where appropriate to verify the request. HSM will respond within the period required by applicable law. 10. CHILDREN'S PRIVACY HSM Condo Collection is intended for adults and is not directed to children. HSM does not knowingly seek to collect personal information from children for participation in the real estate marketplace. If HSM learns that personal information from a child was collected in circumstances requiring deletion or additional consent under applicable law, HSM will take appropriate action. 12. THIRD-PARTY SERVICES AND LINKS HSM Condo Collection may contain links to third-party websites, regulatory authorities, participating professionals, real estate data sources, or other services. HSM does not control the privacy practices of independent third parties. Their collection and use of information is governed by their own privacy notices and practices. 13. INTERNATIONAL ACCESS HSM Realty Inc. is based in the United States. If HSM Condo Collection becomes available for an activated market outside the United States, applicable market, privacy, localization, and operational requirements will be addressed through HSM's controlled market-activation process. The existence of HSM's global-ready technology architecture does not mean that every country or market is currently active or supported. 14. CHANGES TO THIS PRIVACY POLICY HSM may update this Privacy Policy as the platform, services, legal requirements, or information practices change. The “Last updated” date will identify the current version. If a material change requires additional notice or consent under applicable law, HSM will provide that notice or obtain consent as required. 15.
